These Terms and Conditions ("Terms") govern your use of the HolidaysMap API (the "Service"), owned and operated by LUKTEK SRL

By accessing, registering for, or using the HolidaysMap Service and API, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Service.

1. Definitions

  • API: Refers to the HolidaysMap Application Programming Interface, which provides access to public holiday data.
  • API Key: The unique authentication key assigned to your account, required to access the API.
  • Account: Your user account with HolidaysMap.
  • Content/Data: The public holiday information and related data provided through the API.
  • Service: Refers collectively to the HolidaysMap API, website, documentation, and all related services provided by LUKTEK SRL.
  • User/You: Any individual or entity accessing or using the Service.
  • Subscription Plan: The specific service tier (Free, Basic, Premium, Corporate) you select, which defines your API usage limits and features.

2. Your HolidaysMap Account

  • Account Creation: To access the Service, you must register for an Account. You must be at least 18 years old to create an Account. You agree to provide accurate, complete, and current information during the registration process (your name, email address, and password).
  • Account Verification: Your Account will be verified via email. Access to the API will be granted upon successful email confirmation.
  • Account Responsibility: You are solely responsible for maintaining the confidentiality of your Account credentials (username, password, and API Key) and for all activities that occur under your Account. You must notify us immediately of any unauthorized use of your Account or any other breach of security. LUKTEK SRL cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
  • API Key Security: Your API Key is sensitive. You must take all reasonable measures to protect it from unauthorized access or disclosure. Do not embed your API Key directly into publicly accessible client-side code.

3. Use of the HolidaysMap API

  • License: Subject to these Terms, LUKTEK SRL grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the HolidaysMap API solely for your internal business or personal use, as permitted by your chosen Subscription Plan.
  • API Functionality: The HolidaysMap API provides public holiday data collected manually by LUKTEK SRL. The data is delivered via API calls on-demand and is not intended for local caching or long-term storage unless explicitly permitted by your Subscription Plan or a separate written agreement. You must make direct API calls for each data retrieval.
  • Prohibited Uses: You agree not to:
    • Use the API for any illegal or unauthorized purpose.
    • Exceed the usage limits specified by your Subscription Plan.
    • Attempt to reverse engineer, decompile, or disassemble the API.
    • Resell, sublicense, or otherwise distribute the API or its Data to third parties, except as explicitly permitted for integration within your end-user applications.
    • Use the API in any manner that could damage, disable, overburden, or impair our servers or networks.
    • Falsely represent or obscure your identity or the origin of any requests.
    • Use the API for any form of automated scraping or data mining outside of its intended use.
    • Use our logos or brand name without our express prior written permission.
  • Data Accuracy & Contributions: While we strive for the highest accuracy, we do not guarantee that all data is error-free or perfectly up-to-date. Users are encouraged to submit requests for new data or modifications if errors are found or new data is needed.

4. Fees, Payments, and Subscription Plans

  • Pricing: Access to the HolidaysMap API is available under various Subscription Plans, including a free tier and paid tiers, as detailed on our Pricing Page. All prices are listed in EUR and include VAT.
  • Billing Cycles: Paid Subscription Plans are available on both monthly and annual billing cycles. By selecting a paid plan, you agree to pay the applicable fees in advance for the chosen billing cycle.
  • Overages: If your API usage exceeds the limits of your Subscription Plan, your API access will be blocked until the next billing cycle begins or until you upgrade your Subscription Plan.
  • No Price Changes: We currently do not anticipate changing our listed prices for existing Subscription Plans. Should this policy change in the future, we will provide reasonable advance notice.
  • Refund Policy: Refunds are issued only if our API service functions below 90% uptime during a given billing period, as measured by our internal monitoring systems. No refunds will be provided for other reasons, including but not limited to, non-use of the API, cancellation of your Subscription Plan mid-cycle, or changes in your requirements.
  • Cancellation: You may cancel your paid Subscription Plan at any time from your Account Dashboard. Cancellations will take effect at the end of your current billing cycle. No pro-rata refunds will be provided for early cancellations.

5. Service Availability & Support

  • Availability: While we strive for high availability, LUKTEK SRL does not guarantee uninterrupted or error-free operation of the Service. We may perform scheduled or unscheduled maintenance.
  • Support: We provide 24/7 email support for all users, with a typical response time of 6 hours.

6. Intellectual Property

All intellectual property rights in and to the HolidaysMap Service, API, documentation, website content, and any associated software or technology (including all past, present, and future enhancements, modifications, and derivative works) are and shall remain the exclusive property of LUKTEK SRL.

You may not use our logos or company name ("HolidaysMap," "LUKTEK SRL") in any marketing, promotional, or public materials without our express prior written permission.

7. Limitation of Liability and Disclaimer of Warranties

  • "AS IS" Basis: The HolidaysMap Service and API are provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. You use the Service entirely at your own risk.
  • No Guarantee of Accuracy: While we manually compile and maintain our holiday data with care, LUKTEK SRL does not warrant that all data is error-free, complete, or perfectly up-to-date. Public holiday regulations are subject to change by governmental authorities, and it is your sole responsibility to verify the accuracy of any data before relying on it for business-critical decisions, scheduling, legal compliance, or any other purpose.
  • No Responsibility for Your Actions or Decisions: LUKTEK SRL is not responsible, under any circumstances, for any actions, decisions, or omissions you make based on data retrieved through the Service. This includes, without limitation, business decisions, operational scheduling, payroll calculations, legal filings, financial transactions, or any other activity that you undertake using holiday data obtained via the API. Any reliance you place on such information is strictly at your own risk.
  • No Guarantee of Service Continuity: LUKTEK SRL does not warrant that the Service will be uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; or that the Service is free of viruses or other harmful components.
  • Affordable Pricing — No Premium SLA: HolidaysMap is intentionally priced as one of the most affordable public holiday data APIs available on the market. In exchange for this pricing, the Service is provided without a guaranteed Service Level Agreement (SLA) beyond the uptime policy stated in Section 5 and the refund conditions in Section 4. By choosing to use HolidaysMap, you acknowledge and accept this trade-off.
  • Maximum Liability Cap: To the fullest extent permitted by applicable law, LUKTEK SRL's total cumulative liability to you for any and all claims arising out of or related to the Service shall not exceed the total amount paid by you to LUKTEK SRL in the three (3) months immediately preceding the event giving rise to the claim.
  • Exclusion of Consequential Damages: In no event shall LUKTEK SRL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, revenue, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on or related to the Service; (iii) any data obtained from the Service and any decisions or actions taken based on such data; and (iv) unauthorized access, use, or alteration of your transmissions or content — whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Indemnification

You agree to defend, indemnify, and hold harmless LUKTEK SRL and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and API Key; b) a breach of these Terms; or c) any content posted by you on or through the Service (if applicable).

9. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal data.

10. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts located in Romania.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

12. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and LUKTEK SRL regarding our Service, and supersede and replace any prior agreements, oral or otherwise, regarding the Service.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
